1. Agreement to Terms

By downloading, installing, or using the Milestone Tracker mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access or use the App.

2. Description of Service

Milestone Tracker is a mobile application that allows users to track time periods since specific events or milestones. The App provides features including:

• Creating and managing multiple counters
• Setting goals and tracking progress
• Viewing milestones in calendar format
• Setting reminders with local notifications
• Customizing counter appearance

All data is stored locally on your device and is not transmitted to external servers.

3. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your device and any authentication methods
• All activities that occur through the use of the App on your device
• Backing up your data if desired (through device backups)
• Ensuring that your use of the App complies with all applicable laws and regulations

4. Acceptable Use

You agree not to use the App:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• In any way that could damage, disable, overburden, or impair the App
• To attempt to gain unauthorized access to the App or its related systems

5. Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of Milestone Tracker and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

The App logo, name, and all related designs are trademarks of Milestone Tracker. You may not use these without our express written permission.

6. Privacy and Data Storage

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we handle your information. Key points:

• All data is stored locally on your device
• We do not collect or transmit personal information
• You have full control over your data
• Deleting the App removes all associated data

7. Disclaimers

No Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• The implied warranties of merchantability and fitness for a particular purpose
• That the App will be uninterrupted, timely, secure, or error-free
• That the results obtained from the use of the App will be accurate or reliable

Accuracy of Information

While we strive to ensure the App calculates time periods accurately, we make no warranty regarding the accuracy of calculations or the reliability of the App for critical time-sensitive purposes.

8. Limitation of Liability

In no event shall Milestone Tracker, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Resulting from your use or inability to use the App
• Any unauthorized access to or use of your device
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred

9. Indemnification

You agree to defend, indemnify, and hold harmless Milestone Tracker and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

10. Termination

These Terms shall remain in effect until terminated by you or us. We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever.

Upon termination, your right to use the App will cease immediately. You may terminate these Terms simply by discontinuing use of the App and deleting it from your device.

11. Updates and Modifications

App Updates

We may release updates to the App from time to time. These updates may include new features, bug fixes, or changes to functionality. Your continued use of the App after updates constitutes acceptance of any changes.

Terms Modifications

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect through the App or App Store update notes.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding the App and supersede any prior agreements.

14. Apple-Specific Terms

If you access the App through a device made by Apple, Inc. ("Apple"):

• Apple has no obligation to furnish any maintenance and support services with respect to the App
• Apple has no warranty obligation whatsoever with respect to the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms
